This Privacy Policy (hereinafter "this Policy") sets forth the handling of customer personal information in the service (hereinafter "this Service") provided on this website.

Article 1 (Personal Information)

"Personal Information" refers to "personal information" as defined in the Act on the Protection of Personal Information, meaning information relating to a living individual that can identify a specific individual through descriptions such as name, date of birth, address, telephone number, contact information, as well as data such as facial features, fingerprints, voiceprints, and health insurance insurer numbers that can identify a specific individual from the information alone (personal identification information).

Article 2 (Collection Method of Personal Information)

AKibaX may ask for personal information such as name, date of birth, address, telephone number, email address, bank account number, and credit card number when customers register for use. We may also collect transaction records and payment information containing customer personal information from our partners (including information providers, advertisers, advertising distributors, hereinafter "partners").

Article 3 (Purpose of Collecting and Using Personal Information)

The purposes for which AKibaX collects and uses personal information are as follows:

  • For the provision and operation of AKibaX services
  • To respond to customer inquiries (including identity verification)
  • Personal information entrusted by customers will be used for the purpose of shipping products by AKibaX.
  • To identify customers who violate the Terms of Service or attempt to use the service for improper purposes, and to refuse such use
  • To allow customers to view, change, delete their registration information and view usage status
  • To bill customers for paid services
  • Purposes incidental to the above purposes

Article 4 (Change of Purpose of Use)

  1. AKibaX shall change the purpose of use of personal information only when it is reasonably recognized that the changed purpose is related to the purpose before the change.
  2. When the purpose of use is changed, AKibaX shall notify customers or publish on this website by a method prescribed by AKibaX.

Article 5 (Provision of Personal Information to Third Parties)

1. AKibaX shall not provide personal information to third parties without prior customer consent, except in the following cases. However, this does not apply when permitted by the Act on the Protection of Personal Information or other laws.

  • When necessary to protect the life, body, or property of a person and it is difficult to obtain the consent of the person
  • When particularly necessary for improving public health or promoting the sound development of children and it is difficult to obtain the consent of the person
  • When cooperation is necessary for a national or local government agency or a person entrusted by such agency to perform affairs prescribed by law, and obtaining the consent of the person may hinder the performance of such affairs
  • When the following matters are notified or published in advance and the company has filed a notification with the Personal Information Protection Commission
    • (1) The purpose of use includes provision to third parties
    • (2) Items of data provided to third parties
    • (3) Means or method of provision to third parties
    • (4) Suspension of provision of personal information to third parties upon request of the person
    • (5) Method of accepting requests from the person

2. Notwithstanding the preceding paragraph, the following cases shall not be deemed as provision to third parties:

  • When AKibaX entrusts all or part of the handling of personal information within the scope necessary to achieve the purpose of use
  • When personal information is provided due to succession of business due to merger or other reasons
  • When personal information is jointly used with specific parties and the person has been notified in advance or can easily know the details of such joint use

Article 6 (Disclosure of Personal Information)

1. When AKibaX is requested by a person to disclose personal information, it shall disclose it to the person without delay. However, if any of the following applies, it may not disclose all or part of it, and if it decides not to disclose, it shall notify the person to that effect without delay. A fee of 1,000 yen per case shall be charged for disclosure of personal information.

  • When there is a risk of harming the life, body, property, or other rights and interests of the person or a third party
  • When there is a risk of significantly hindering the proper implementation of AKibaX's business
  • When it would otherwise violate laws and regulations

2. Notwithstanding the preceding paragraph, information other than personal information, such as history information and characteristic information, shall not be disclosed in principle.

Article 7 (Correction and Deletion of Personal Information)

  1. Customers may request AKibaX to correct, add, or delete (hereinafter "correction, etc.") their personal information through procedures prescribed by the company when the personal information held by AKibaX is incorrect.
  2. When AKibaX receives a request under the preceding paragraph and determines that it is necessary to respond to the request, it shall correct the personal information without delay.
  3. When AKibaX has made a correction, etc. or has decided not to make a correction, etc., it shall notify the customer without delay.

Article 8 (Suspension of Use of Personal Information)

  1. When AKibaX is requested by a person to suspend or erase the use of personal information (hereinafter "suspension of use, etc.") on the grounds that the personal information is being handled beyond the scope of the purpose of use or was obtained by improper means, it shall conduct the necessary investigation without delay.
  2. Based on the investigation results of the preceding paragraph, when it is determined that it is necessary to respond to the request, the suspension of use, etc. of the personal information shall be carried out without delay.
  3. When AKibaX has carried out the suspension of use, etc. or has decided not to carry out the suspension of use, etc., it shall notify the customer without delay.
  4. Notwithstanding the preceding two paragraphs, when the suspension of use, etc. requires significant expense or is otherwise difficult to carry out, and alternative measures necessary to protect the customer's rights and interests can be taken, such alternative measures shall be taken.

Article 9 (Changes to Privacy Policy)

  1. The contents of this Policy may be changed without notifying customers, except for matters separately specified in this Policy or other laws.
  2. Unless otherwise specified by AKibaX, the revised Privacy Policy shall take effect when it is posted on this website.
